The Ministry of Labour and Employment called for a meeting of representatives of Central TUs and Employers Organisation for a discussion about the “reported violent incidents in Industrial Units in Delhi and National Capital Region (NCR)”.
The meeting held on 9th February was chaired by the Union Minister for Labour and Employment Shri Mallikarjun Kharge. It was attended by Labour Ministers from Delhi, Haryana and UP was represented by Labour Commissioner.
Council of Indian Employers (CIE), Confederation of Indian Industries (CII), Laghu Udyog Bharati (LUB), Associated Chambers of Commerce and Industry (ASSOCHAM) represented employers.
National leaders of all Central Trade Unions and leaders from concerned states attended the meeting. Tapan Sen, General Secretary and K.M. Tiwari, Secretary Delhi State Committee attended from CITU.
Union Labour Minister said that the meeting has been called in the wake of some violent incidents reported in Delhi and NCR. He urged that sustained dialogue among all the stake holders can avoid recurrence of any violent incidents in Industrial Sector and maintain industrial peace and harmony.
FICCI went on record to say that they are “in favour of proper implementation of labour laws” and that before registering unions in any establishment, concerned employers needed to be consulted. CII recorded that “CII welcomes the formation of Trade Unions but a consultative approach is needed and violence can not be tolerated”. LUB stated that “the labour laws need to be revised and suggested that reconciliation and consultation in the formation of Union should be legalised”. ASSOCHAM was of the opinion “that Trade Unions are must and should be registered. There should be only one recognized union in an industrial establishment”. CIE wanted that the parties should sit together and discuss to sort out the issues.
While the Labour Minister of Delhi said the “Govt. of Delhi is maintaining harmonious relations among the employees and employers”, the Labour Minister of Haryana suggested that “payment of wages to the workers may be made through Cheque “ to tackle under payment of wages. He also stated that “there should be no difference between the contract workers and regular workers as both are engaged in similar work”.
Trade Union leaders raised the issues of workers being made to work for 10 to 12 hrs but paid only for 8 hours; contract system continuing for years and various exploitations connected with that; Non implementation of labour laws, denial of trade union rights and registration of TUs not being allowed, and non payment of minimum wages etc.
Tapan Sen, MP and General Secretary, CITU noted that “the law enforcement machinery is not working due to shortage of staff, while only 10% of workers are employed on regular basis, 90% are on contract basis. Minimum Wages are not being paid and this creates lot of unrest among workers”. He suggested a review of Trade Union Act and recognition of Trade Union made mandatory. He brought to the notice of the meeting that in NOIDA and other centers, no unions were registered and workers were not getting an opportunity to ventilate their rightful grievances. He also demanded that law enforcement machinery must play an impartial role. Tapan Sen also explained certain recent developments and struggles, where the right to form a union has been denied and workers were victims of violent attacks.
